Insamlingsstiftelsen Help to Help, Reg. No. 802478-3725, (“Help to Help”, “we”, “us”) caresabout your privacy and takes all necessary measures to make sure that your personal data arebeing processed by us in a lawful, fair and transparent manner. All personal data processed byus as a controller is processed in accordance with applicable law, including the General DataProtection Regulation (the “GDPR”), supplementary national legislation, as well as practices,guidelines and recommendations issued by a national or EU supervisory authority (“Applicablelaw”).

We process your personal data to provide and improve the funding operation (the “Service”). Itis essential for us that you understand what personal data it is that we collect, and why. In thispolicy we therefore describe how and the purposes for which we use your personal data whenyou use our Service as well as what lawful basis we use and what measures we take to protectyour personal data. We also provide information on how you may exercise the rights you havelinked to our processing of your personal data. Unless otherwise stated, Help to Help is thedata controller for personal data we collect through the Service subject to this privacy policy.

Some pages on our website contain links to third party websites. These websites have theirown privacy policies and Help to Help is not responsible for their operations or theirinformation policies. Hence, any user who sends information to or through such third partywebsites should review the privacy policies posted on those websites before any personal datais transferred to them.

2. About us and our services

Help to Help accepts monetary donations from individuals, organisations, companies,government authorities, other institutions, and via established corporate partnerships(“Donors”).

Help to Help is responsible for ensuring that the funds raised are used to fulfil the vision,mission and objectives of the organisation in accordance with the organisation’s bye-laws andconstitution:

“Help to Help Foundation, (the “Foundation”), works to create positive development in developingcountries by providing scholarship grants for, and/or offering loans to, post-secondary studies foryoung students. The Foundation may use funds to support other purposes enabling education foryouth. Furthermore, the Foundation shall foster cooperation between students and the labour marketand provide help and support on issues regarding entrepreneurship and professional life. To anappropriate extent, the Foundation can assist companies to recruit students from Help Help’snetwork. Activities shall be conducted in such a way that funds raised from Donors are used to fulfilthese objectives. The Foundation is politically and religiously independent.”

We offer Donors and other stakeholders (the “Users”) to use our website, as a part of theService, to get information about Help to Help’s work and our students (the “Beneficiaries”), tosubscribe to our newsletter, sign up for events, and to make donations via so-calledcrowdfunding, purchasing gift cards, making a monthly donation or a general donation.

Help to Help is revised by the Swedish Fundraising Control and Länsstyrelsen (The County Administrative Board) in Stockholm. Read more about their regulations and control by clicking on each name above.

3. WHAT PERSONAL DATA DO WE COLLECT ANDWHERE FROM?

The personal data we may collect may, depending on the context, include:
  • your full name, date of birth, and contact details, such as your address, telephone number,or email address;
  • usage data such as your computer’s Internet Protocol address (e.g. IP address), browsertype, browser version, the pages of our Service that you visit, the time and date of yourvisit, the time spent on those pages, unique device identifiers and other forms ofdiagnostic data;
  • information about your donation (e.g. type of donation and financial details such asaccount number);
  • in case you sign up for an event we collect food information and information on whichevents you have attended, publications received and if you have made special requests forprogram information;
  • if you sign up to a volunteer engagement we collect the provided information, includedbut not limited to, age, profession, gender and employer;
  • job or internship applications, including cover letters, resumé, and photos (as applicable);
  • other information that is relevant for customer surveys, advertisements/marketing oroffers; and/or
  • other user-generated content purposely provided by you via our website or in connectionto our communication with you.
Help to Help may collect your personal data from the following sources:
  • Help to Help’s website, e.g. when you make a crowdfunding donation or a monthlydonation, subscribe to our newsletter, activate a gift card, sign up for an event;
  • by way of agreement, invoice or other business contact, if you are a customer or acontact person for any of our business partners;
  • when you contact us by email, telephone, mail or other correspondence;
  • from third parties in the form of social media, public records, any of our business partnersor in connection with communication with references provided by you.

4. WHY DO WE PROCESS YOUR PERSONAL DATA?

Help to Help may use your personal data for the following purposes and based on the following legal grounds:
Contractual obligation:
  • In order to administrate your donation or order.
  • For the performance of the Services.
  • For recruitment process.
Legitimate interests:
  • Communication: for us to be able to communicate with you by e-mail or other communication tools we process the personal data you provide us with such as telephone number and e-mail address. Such communication may include, butare not limited to, notifying you about changes to our Services, to providecustomer support.
  • Technical issues: to be able to detect, prevent and address technical issues withour digital services such as the application system, the administrative systems and the Sites.
  • For marketing purposes: in order for us to market our Service in the best possible way and to reach as many Donors as possible, we process your personal data. This include to be able to provide you with news, special offersand general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information.
  • Analytics and statistics: to be able to monitor the usage of our Service, improve and develop our Services and communication, we process your personal data such as the usage of our Services for analysis.
  • Photos: in order to publish pictures from our events.
Compliance with a legal obligation:
  • We process your personal data in order to comply with legal obligations to which we are subject. This entails that we e.g. save invoices and payments according to the Swedish Accounting Act.

  • Newsletter: If you have subscribed to our newsletter we process your personal data (email) to be able to send you our latest newsletter.

  • Participation in interactive features: To allow you to participate in interactive features of our Service when you choose to do so.

5. SECURITY MEASURES

We protect your personal data by maintaining physical, organizational and technological safeguards appropriate to the sensitivity of such personal data. Personal data may only be accessed by persons within Help to Help who require such access to carry out our purposes as described above.

6. RETENTION OF PERSONAL DATA

Help to Help will retain your personal data only for as long we deem it necessary for the purposes set out in this privacy policy. Help to Help will also retain usage data for internalanalysis purposes. Usage data is generally retained for a shorter period of time, exceptwhen this data is used to strengthen the security or to improve the functionality of ourService, or we are legally obligated to retain this data for longer time periods. 7. TRANSFER OF PERSONAL DATA

Help to Help only transfers personal data as described below. We always observe great caution when transferring your personal data and your personal data is only transferred in accordance with this privacy policy and after taking appropriate security measures. We donot sell personal data about our users and customers to third parties. Help to Help may transfer your personal data in the following situations:
  • Help to Help Tanzania. Help to Help works in close collaboration with its sister companyHelp to Help Tanzania and may transfer your personal data for the purpose of carrying out Service.
  • Business Partners. Our business partners will get access to your personal data to the extent necessary for them to fulfil their obligations relating to your donation.
  • Service Providers. In connection with providing various products and/or Services to youHelp to Help may employ third party companies and individuals to facilitate our Service(“Service Providers”), to provide the Service on our behalf, to perform Service-related services or to assist us in analysing how our Service is used. This include using the Service Providers’ platforms for internal communication. These third parties have access to your personal data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
  • Academic and non-governmental organization partners. We may share your personal data with these partners if they assist us with carrying out our purposes. They may not use the personal data for any other purpose than those determined by us.
  • Business transactions. If all or part of our operations is sold or integrated with any other business, operation or company, your personal data may be disclosed to our advisors,potential buyers and their advisors, and be transferred to the new owners of theoperation.
  • Cookies and other technological means. If you allow cookies and other technologicalmeans when you visit the Sites, any personal data collected about you and your behaviour on the Sites may be collected by us using cookies or other similar techniques.
  • Legal obligations. Your personal data may also be disclosed for the purpose of Help toHelp’s compliance with certain legal obligations and it may be transferred to the Police and other relevant public authorities when permitted and required by law.
Your personal data may be transferred to countries outside of the EU/EEA, more specifically toTanzania and Uganda, as Help to Help is directed to students in Eastern Africa and therefore have business partners and Service Providers in those countries. When such transfers are carried out, Help to Help takes all appropriate measures to ensure that your personal data is adequately protected and that all processing is performed in accordance with this privacy policy. Help to Help will ensure that appropriate protective measures are taken by securingthat at least one of the following conditions are met:
  • the EU Commission has decided that the third country ensures an adequate level ofprotection;
  • the transfer is subject the examination procedure referred to in article 5 of regulation(EU) No 182/2011, including, but not limited to, the standard contractual clauses issuedby the European Commission in decision (EU) 2021/914;
  • the recipient has adopted binding corporate to standard data protection clauses adopted by the European Commission, or by a supervisory authority and approved bythe European Commission, in accordance with rules for the processing, which have been approved by the relevant supervisory authority and the recipient of the personal data in the third country is bound by these rules;
  • the transfer is necessary for the performance of a contract between you and Help to Help or the implementation of pre-contractual measures taken at your request;
  • the transfer is necessary for the conclusion or performance of a contract concluded in the interest of you between Help to Help and another natural or legal person; or
  • Help to Help has collected your consent prior to the transfer.

8. YOUR RIGHTS

Help to Help aims to take reasonable steps to allow you to correct, alter, delete, or limit the use of your personal data. In certain circumstances, you have the right to: Access and receive acopy of the personal data we hold about you, alter any personal data held about you that is inaccurate, request the deletion of personal data held about you.

To access and receive a copy of the personal data we hold: You have the right to get a transcript of the personal information Help to Help holds about you free of charge. You canrequest to obtain a copy of your personal data by sending us a signed written request tothrough the contact details stated under “Contact us” below. Should you demand a second transcript within 12 months from your previous request, we could ask for a fee to cover the costs related to administering your request.

To alter any personal data held about you that is inaccurate: Whenever made possible, youcan alter your personal data directly by contacting us. You can opt out of receiving newsletters and marketing communications from Help to Help by following the instructions included in any email sent to you via the “Unsubscribe” tab. We respect your choice, and we will stop sending you informative and/or promotional emails once you unsubscribe. Please note, regardless of your communication settings, we will continue to communicate with you regarding changes to terms and conditions, policy updates, service interruptions, data breaches or other significant information about our Services.

We rely on you to ensure that your personal information is complete, accurate and up to date.Please do inform us of any changes in your personal data by contacting info@helptohelp.se. Wewill respond to your request as soon as possible but certainly within 30 days.

To request the deletion of personal data held about you: For purposes of clarity, you areentitled to terminate your subscription to our Services, such as a monthly donation ornewsletter, at any time, at what point all information connected to your account will either bedeleted or anonymised. However, binding legal requirements may require that we store certaininformation for various periods of time. In order to comply with these regulations, we may beunable to delete information from our databases. You may at any time request to be erasedfrom Help to Help’s registers and databases by contacting us via details stated under “Contactus” below. Should you wish so, we will delete all contact information to you.

Withdrawal of consent: Where we are using your personal information on the basis of yourconsent, you are entitled to withdraw that consent at any time. Moreover, where we processyour personal information based on legitimate interest or the public interest, you have the right to object at any time to that use of your personal information.

Complaints: Help to Help is committed to handle any request, complaint or concern that youmay have about our use of your personal data in a fair and transparent way. If, however, youbelieve that we have not been able to assist with your complaint or concern, you may have the right to file a complaint with the data protection authority in your country (if one exists in your country) or supervisory authority. 9. CHILDREN’S PRIVACY

Children’s privacy
Our Service does not address anyone under the age of 18 (“Children”). We do not knowinglycollect personally identifiable information from anyone under the age of 18. If you are a parentor guardian and you are aware that your Children has provided us with personal data, pleasecontact us. If we become aware that we have collected personal data from Children withoutverification of parental consent, we take steps to remove that information from our servers.

In order to use our Service one must be 18 years and above and/or commit to entering into anagreement with Help to Help by accepting this policy.

10. CHANGES TO THE PRIVACY POLICY

Please note that the terms of this privacy policy may be changed or amended at any time. The privacy policy published on the Sites will always reflect the most recent version. Consequently, you should review these terms on a regular basis to make sure that you are satisfied with the changes. In case of any material changes we will, however, email you (if you have given us youremail address) to make you aware of any changes made.
